On September 30, 2024, the Amherst Circuit Court judge upheld the jury's sentence of sixteen years of incarceration for Joseph Cunningham. Joseph had been found guilty on May 30 of this year of Second Degree Murder against Kevin Hartless, who he shot and killed in the National Forest in January of 2023. Joseph's attorney argued for a reduction in the sentence, but the judge ruled in favor of Commonwealth's Attorney Lyle Carver and imposed the entire sentence of sixteen years.
