Judge Denies Joseph Cunningham's Motion to Set Aside Jury Verdict

On December 19, 2024, the Amherst Circuit Court Judge denied Joseph Cunningham's Motion to Set Aside the Jury Verdict. Cunningham was convicted in May of murdering Kevin Hartless and received a sentence of sixteen years. The judge agreed with Commonwealth's Attorney Lyle Carver's arguments and ruled that the court did not have jurisdiction to hear the motion because more than 21 days had passed. The judge further opined that he would have denied the motion even if it had been heard within the time limits.
