Timothy Elliott sentenced to 50 years

On December 29, 2022, The National Center for Missing & Exploited Children notified the Amherst County Sheriff’s Office of a possible child exploitation event that had occurred in Madison Heights on July 28, 2022.  The tip involved possible pornographic images of prepubescent female being either uploaded or downloaded on the internet.  Search warrants were obtained by investigators with ACSO for multiple online platforms and accounts.  The information obtained by these search warrants led to the execution of a search warrant at the home of Timothy Charles Elliott.  All of Elliott’s electronic devices were seized and the information on them was later downloaded.  Elliott was arrested December 7, 2023, for 10 counts of possession of child pornography and held with no bond.  He waived his preliminary hearing on February 7, 2024.


On February 27, 2024, Elliott pled guilty to all charges.  The Court ordered that the office of probation and parole complete a presentence report which was submitted to all parties.  On June 12, 2024, after evidence was introduced by the Commonwealth and the defendant, the Court sentenced Elliott to 50 years in prison, with 41 years suspended, leaving an active sentence of 9 years. He will also be on good behavior for a period of 30 years, supervised probation for 2 years upon his release, and register with the Virginia State Police sex offender registry.  Elliott was also ordered to participate in sex offender treatment and his internet usage will be at the discretion of his probation officer.


EDIT: On October 18, 2024, the defendant filed a motion with the court to modify his sentence, and our office filed a motion objecting to any such modification.  The court denied the motion on November 8, 2024.
